Do You Need a Permit to Build a Deck in Massachusetts?

In Massachusetts, you almost always need a building permit to construct a deck — most towns require one for any deck attached to the house or over a certain height (often 30 inches). Building without a permit risks fines, failed home sales, and unsafe construction. RS Development Group handles the full permit process for you — call (774) 512-3176.

Why do decks require a permit?

A deck is a structure people stand on, often several feet off the ground, so it must meet the Massachusetts State Building Code for footings, framing, ledger attachment, guards, and stairs. Improperly built decks are a real safety hazard — deck collapses almost always trace back to a poorly attached ledger or undersized footings. Permits and inspections exist to prevent exactly that.

What do deck inspectors check?

  • Footings poured below the ~48-inch New England frost line so frost heave can’t lift the deck.
  • A properly attached and flashed ledger board — the #1 factor in deck safety.
  • Correctly sized joists, beams, and posts for the span and load.
  • Guard height, baluster spacing, and stair rise/run to current safety code.

Can I build the deck myself?

You can, but a licensed contractor pulls the permit, builds to code, and passes inspection the first time — and because framing is our specialty, the footings, ledger, and framing are done right. That’s the difference between a deck that lasts decades and one that becomes a liability. Call (774) 512-3176 for a free deck estimate.
